In accordance with Article 10 of Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), the identification details of the owner of this website and the conditions governing its use are set out below. This English version is provided for convenience; in case of discrepancy, the Spanish version prevails.

2. Purpose

This website provides information about Arkivion, backup software for Windows with a web management portal, and allows you to download the agent, create an account and access the portal.

Accessing and browsing the website makes you a user and implies acceptance of this legal notice. Purchasing and using the service are also governed by the Terms and conditions, and the processing of personal data by the Privacy policy and the Cookie policy.

3. Conditions of use

Users agree to use the website lawfully and diligently and, in particular, not to:

  • use it for purposes that are unlawful, contrary to public order or that may infringe the rights of third parties;
  • attempt to gain unauthorised access to restricted areas, other users' accounts or systems of the owner or its providers;
  • introduce malware or take actions that could damage, overload or impair the normal operation of the website or the service;
  • make automated or abusive use of the forms or application programming interfaces (API).

4. Intellectual and industrial property

The contents of the website (texts, design, logos, screenshots, source code and software), as well as the Arkivion trade name and brand, belong to the owner or are used with the authorisation of their respective owners. Reproduction, distribution, public communication or transformation without express authorisation is prohibited, except where permitted by law.

The Arkivion agent includes open-source components, such as restic, which are distributed under their own licences. Nothing in this notice limits the rights granted by those licences.

5. Liability

The owner strives to keep the information on the website accurate and up to date, but does not guarantee that it is free of errors or omissions and may change the content at any time.

The owner does not guarantee the continuous availability of the website and shall not be liable for damage arising from interruptions, technical failures or causes beyond its control, without prejudice to the Terms and conditions applicable to customers of the service and to any liability that cannot be excluded by law.

The website may contain links to third-party sites (for example, GitHub to download the installer). The owner does not control those sites and is not responsible for their content or privacy policies.

6. Data protection

The processing of users' personal data is described in the Privacy policy, and the use of cookies and similar technologies in the Cookie policy.

7. Governing law and jurisdiction

This legal notice is governed by Spanish law. Any dispute shall be submitted to the courts of Málaga, unless the user is a consumer, in which case the courts of the consumer's place of residence shall have jurisdiction in accordance with consumer protection law.
